In relation to the usage of Bursa Malaysia Market Data, You acknowledge and agree to the following:

1. The transmission of Market Data is conditional upon Your strict compliance with the provisions set forth herein, and IFPL may, with or without notice to You, discontinue transmission of Market Data whenever in IFPL’s judgment there has been any breach by You or any entity on behalf of You, of any of the provisions herein, or whenever directed to do so by Bursa Malaysia.
2. IFPL shall have the right at any time without cause to stop the dissemination of Market Data to You upon being directed by Bursa Malaysia to do so.
3. Neither IFPL nor Bursa Malaysia guarantee the sequence, timeliness, accuracy or completeness of any of the Market Data. Neither IFPL nor Bursa Malaysia shall be liable for non-performance or interruption of transmission due to any cause whatsoever, including any omission or negligence on the part of IFPL or Bursa Malaysia. Neither IFPL nor Bursa Malaysia shall be liable for any reason whatsoever to You or to any other person for any delays, inaccuracies, errors or omissions in the Market Data, or in the transmission of such Market Data, or for any damages arising therefrom or occasioned thereby, including economic, financial, material, personal or consequential loss or damage.
4. Bursa Malaysia shall not be liable in any way whatsoever to You or any other person whatsoever for any economic, financial, material, consequential, or personal losses or damage resulting from actions or decisions based on, or as a result of, Market Data received directly or indirectly from IFPL.
5. You shall indemnify each of IFPL, Bursa Malaysia and their respective officers, employees and agents against all loss, actions, proceedings, costs, claims and damages arising from:
   1. any breach by You of Your obligations herein;
   2. any reliance by any third party on the Market Data obtained through, or from, Your utilisation of the Market Data; or
   3. any defect in or abuse or misuse or failure of operation or performance or breakdown of such equipment or any part(s) of such equipment at any time.
6. You shall not use or permit the Market Data to be used other than for Your own internal purposes, and shall not, and shall not permit any third party to, use or distribute, or purport to use or distribute, the Market Data.
7. You acknowledge that the Market Data provided to it is confidential and remains the valuable property of Bursa Malaysia. You agree and undertake to keep confidential, and shall not without the prior written consent of Bursa Malaysia disclose to any third party, the confidential information (including the Market Data).
8. You shall not allow any other person to:
   1. use the Market Data to compile a stock index on the Malaysian stock market or on securities or derivatives quoted or traded on Bursa Malaysia, which would enable or facilitate index based trading to be conducted by any market or person;
   2. use the Market Data to create any derivatives works for any purposes whatsoever;
   3. engage in the operation of any unlawful business nor allow any other unauthorized or unlawful usage of the Market Data in contravention of any terms of this Agreement or any applicable laws, rules and regulations; or
   4. commercially exploit the Market Data in any other manner whatsoever contrary to the intent and spirit herein.

Financial Terms

You agree to pay Market Data fees as stipulated by IFPL from time to time.

Termination

1. The provisions herein shall enter into effect once You access This Site and it shall continue in effect without expiration unless You unsubscribe to Bursa Malaysia Market Data or IFPL notifies You of its intent to discontinue providing the Market Data.
2. IFPL shall automatically terminate and cut off the flow of Market Data at any time, without any liability, and/or owing any compensation, to You, if You do not comply with the terms and conditions set forth herein concerning the Market Data transmission.
